PRICES AND TAXES

1. Prices Guarantee

The sale price of products published on the KiWAMi website are net prices VAT included. These prices are guaranteed except in the case of modification of the TVA by the French Authorities.

The prices do not include delivery costs, customs charges, import taxes or any other taxes that may apply to Departments, Territories or countries other than metropolitan France. A detailed invoice is delivered to the client along with the order.

2. TVA and other taxes

         METROPOLITAIN FRANCE AND THE EUROPEAN UNION:

The items that you order are subject to the French VAT of 20%. You do not have any additional taxes to pay when you receive your order.You will not be able to recuperate the French VAT that is included in the price.

         THE REST OF THE WORLD INCLUDING DOM TOM:

Items that you order are not subject to French VAT or other taxes concerning our product and it's delivery to you. Your invoice is non-inclusive of French VAT.

Your purchases may be subject to duties or taxes imposed by your own government, department or territory. KiWAMi is not liable for any such expenses.

PRODUCT DELIVERY

Delivery to Metropolitan France and the European Union :

FEES AND DELIVERY DELAYS:

The costs of delivering a package vary according to the detail of the order (number of items and total weight), the destination and the delivery option you choose.

DELIVERY COSTS AND DELAYS:

The costs of delivering a package vary according to the detail of the order (number of items and total weight). Orders between 0 and 30kg will be delivered within 8 working days from the date of reception of payment for the order, providing the ordered item is available in current stock. If any item is unavailable at the time your order is received, KiWAMi will contact you as soon as possible to arrange an exchange or re-imbursement.

DELIVERY OPTIONS:

KiWAMi offers you the choice to be delivered by:

1. Fast post.

2. Courier.

These options are available when purchasing on the KiWAMi website. For more information please contact KiWAMi directly. We will be pleased to help find the best solution for you.

DELIVERY PROBLEMS:

KiWAMi accepts no responsibility for delays of delivery or lost parcels due to the fault of the transporter, or employee actions such as strikes.

If your order has not been delivered in the 8 working days promised, without warning from KiWAMi , contact KiWAMi by email contact@kiwamitriathlon.com, or telephone / fax +33 5 5932 2936. KiWAMi will contact the delivering authority and track the parcel. An investigation by the post can take up to 21 days.

If, after having received your parcel, you discover the contents do not correspond to your order (e.g. you ordered an Amphibian size M and have received an Amphibian size L), contact KiWAMi by email contact@kiwamitriathlon.com, or telephone / fax +33 5 5932 2936.

KiWAMi will advise you of the procedure to follow in order to exchange the item of the correct one. Please retain the product in it’s original packaging. KiWAMi will pay the cost of returning the item only if an error has been made by KiWAMi itself.

Delivery to the Rest of the World + DOM TOM

If your destination does not appear as an option on KiWAMi’s list of countries, please contact KiWAMi directly.

PAYMENT OPTIONS

The customer can choose from various payment options on the KiWAMi website. After the payment has been validated, you will receive confirmation of the payment. The amount of your order will be debited from your account only at time your actual order is sent to you by KiWAMi. Only the amount of the items sent to you and the delivery costs will be debited from your account.

1. Secure internet transaction information:

Whenever you pay by credit card on our website, KiWAMi guarantees you a secure and confidential transaction. Your credit card number is processed by the association SPPLUS, which has been carefully selected by KiWAMi for their ability to ensure total security of your credit card information. All credit card transactions are crypted and protected. This ensures that your credit card details do not circulate on the internet. Your account is debited to the total amount of your purchases and delivery costs the same day as you make the order.

Only customers resident in countries where the delivery costs are calculated automatically online and shown alongside the contents of their shopping cart are able to purchase online. For customers from other courtiers, please contact KiWAMi directly at contact@kiwamitriathlon.com.

Only credit cards with the acronyms CB, VISA, EUROCARD or MASTERCARD are accepted. An order confirmed by the customer online is valid only when the credit card central network system authorises the transaction. If the transaction is not authorised by the CCCNS, KiWAMi reserves the right to cancel the order and stop the delivery of the product.

2. Payment by telephone or fax:

Payment by email, telephone or fax is possible for customers who do not wish to provide credit card information on the KiWAMi website, providing the delivery costs are able to be calculated by the website. For customers from other countries, fill in the order form from the website or KiWAMi catalogue, and contact KiWAMi directly by telephone or fax. You will be required to provide your credit card number and its expiry date, along with the details of your order and your delivery address. Only credit cards with the acronyms CB, VISA, EUROCARD or MASTERCARD are accepted.

An order validated by a customer and transmitted by email, telephone or fax is effective only when the central credit card system has accepted the transaction. If a transaction si refused KiWAMi reserves the right to cancel the order and stop delivery of it. The customer will be contacted as quickly as possible. Your bank account is debited to the total amount of the items purchased and delivery costs the same day you place your order.

3. Payment by cheque in the post:

After having correctly filled in the KiWAMi order form (found on the KiWAMi website or in all KiWAMi catalogues), send the order form along with a cheque in Euros to the order of KiWAMi SARL to the following address:

Your cheque, equal to the total amount in euros of the items you wish to purchase and the transportation costs, will be banked the day your order is sent.

4. Non-acceptance of payment

You wish to make a purchase on the KiWAMi website but you are unable to validate the payment by credit card.

Verify that the credit card you wish to use is accepted on the KiWAMi website (Carte-Bleu, MasterCard, EuroCard or VISA). Verify that the credit card information you have provided is correct.

Your payment was not validated by our services.

The bank managing the account of credit card details you have provided has not allowed the transaction to take place. Please contact your bank to fix the problem before re-ordering. In the meantime, your order is automatically cancelled.

RETURN AND EXCHANGES

IF WITHIN 15 DAYS from the date of reception of your purchase you are unhappy with your KiWAMi purchase please contact us by email contact@kiwamitriathlon.com or telephone / fax (+33 5 5932 2936). We will do our best to find a solution to the problem with you.

Please make sure you check your order as soon as possible after receiving it. Note any error in the model, color, size and quantity of each item. All garments should be tried on over top of underwear and without removal of the labels or tags.

You have 15 days to return a product to Kiwami for re-imbursement. For exchange (size / colour) or re-imbursement of a product, it is the sole responsibility of the customer to organize and pay for sending the product back to Kiwami. KiWAMi will re-imburse you for the total amount you paid for the item excluding delivery costs. For all product returns between the legal deadline of 15 days after purchase, Kiwami will create a credit voucher equivalent to the total amount you paid for the item excluding delivery costs. This credit will be valid for use on the Kiwami Europe website for a period of 3 months from the date of issue. We require all products returned to Kiwami for exchange or re-imbursement to be in new condition, unsoiled, unused, in their original packaging and with all hang tags and labels attached.

Returns of any on-sale items or any items purchased at special discounted rates must be sent back to Kiwami within 15 days of receiving them. The reference date for these returns in the date marked on the returned package by the delivery company. These returned items are refunded in the form of a credit that can be used only at kiwamitriathlon.com. It is the sole responsibility of the customer to organize and pay for sending the product back to Kiwami. We require all return products to be in new condition, unsoiled, unused, in their original packaging and with all hang tags and labels attached.

IN THE CASE OF A SIMPLE PRODUCT RETURN, KiWAMi will re-imburse you for the total amount you paid for the item excluding the delivery cost. In the case of a product exchange (size / colour), the customer will have to re-order the product and Kiwami will re-imburse you, on your Credit card or Paypal account,  for the total amount you paid for the item excluding the delivery cost

The cost of re-delivery is the responsibility of the customer.

IN ALL CASES, the customer is obliged to return the product to KiWAMi in perfect condition, unsoiled, unmarked, undamaged in any way, in it’s original packaging, with the original labels and tags attached and accompanied by the purchase invoice. In the case of non-conformity to any of these conditions, KiWAMi reserves the right to refuse an exchange or re-imbursement.

CUSTOMER RIGHTS

CUSTOMER RIGHTS / CUSTOMER FILES :

In order to be able to meet your needs and provide an optimal service, we need to record record some personal information such as name, address, email and telephone number. This information is essential for KiWAMi to be able to process your order effectively. All personal information is kept confidential by KiWAMi.

In virtue of the 06/01/1978 freedom and information law, KiWAMi guarantees you right of access to and modification of this information. Simply write to KiWAMi, precising your full name and address. All bank account information you communicate to KiWAMi during an online purchase is not filed, recorded or visible on the internet. No one is able to intercept the information you send. Thanks to the security system SPPLUS, KiWAMi assures the confidentiality of your information.

MANUFACTURER RIGHTS:

It is strictly forbidden by the french law (Intellectual Property Code, Article L 713-2) to cover, alter or modify the KiWAMi logo or any other brand identification present on any KiWAMi products or their packaging. When buying a Kiwami product, the customer engages to formally respect the law. The brand KiWAMi and the KiWAMi logo are registered internationally.

DISPUTES:

Disputes arising from the enforcement of the general sales condition are subject to French common law before the Tribunal de Pau (Pyrénées Atlantiques), France.
